Privacy Policy
How sumwon collects, uses, and protects your information.
This Privacy Policy explains how [COMPANY LEGAL NAME] (“we,” “us,” or “our”), the operator of the sumwon service, collects, uses, shares, and protects information when you interact with us by text message (SMS/MMS) or voice call at the phone number we publish (the “Service”). By texting or calling us, you agree to this Policy.
01 What the Service is
sumwon is the service through which you reach an artificial-intelligence persona named “someone,” by SMS or by voice call. It is an AI, not a human being. The Service is intended for personal, conversational, and entertainment purposes for adults aged 18 or older. It is not a counseling, medical, legal, financial, or crisis service. If you are ever in crisis or danger, contact your local emergency number, or in the U.S. call or text 988 (Suicide & Crisis Lifeline) or call 911.
02 Information we collect
- Your phone number (in E.164 format), which is how we recognize you across both text and voice so your conversation feels continuous.
- Message content — the text of messages you send and that we send back.
- Call audio and transcripts — when you call, the call is processed and transcribed so the Service can understand and respond. See Section 08.
- Interaction metadata — timestamps, message/call duration, channel (text or voice), and delivery status.
- Consent and preference records — your opt-in, opt-out (STOP), and related choices, with timestamps, kept to honor your preferences and for compliance.
- Derived memory — summaries and facts the Service forms from your conversations so it can remember you over time. This is generated from the above; we do not collect it from anywhere else.
We do not ask for, and you should never send, sensitive information such as government IDs, payment-card numbers, account passwords, or financial-account details. We do not knowingly collect precise location, and we do not buy personal information about you from data brokers.
03 How we use information
- To operate the Service: receive your messages and calls and generate responses.
- To maintain memory keyed to your phone number, so the same persona remembers you across text and voice.
- To send you the messages you have opted in to receive, and to honor STOP/HELP and quiet-hour preferences.
- To keep the Service safe — detecting distress, preventing misuse, and enforcing our Terms.
- To maintain records required for legal and regulatory compliance (including messaging consent).
- To improve the Service. [CONFIRM WITH COUNSEL: whether conversation content is used to improve or train models, and offer an opt-out if so.]
04 Text-messaging program & consent
When you text our number first, you are starting a conversation, and we reply. Before we send you any proactive or recurring messages, we ask for your express consent, and we only send them if you agree.
- Message frequency varies based on your interaction.
- Message and data rates may apply, per your mobile carrier’s plan.
- Reply STOP at any time to opt out; we will stop sending proactive messages. Reply HELP for help and contact information.
- Carriers are not liable for delayed or undelivered messages.
We do not sell your personal information, and no mobile information (including your phone number or consent) will be shared with third parties or affiliates for marketing or promotional purposes.
05 AI disclosure
You are interacting with an artificial intelligence. The persona may be mysterious about itself, but if you genuinely ask whether it is an AI, or appear confused about its nature, it will tell you plainly that it is an AI. Responses are generated automatically and may be inaccurate; do not rely on them as professional advice of any kind.
06 How we share information
We share information only with service providers who help us operate the Service, under contracts that limit their use of it to providing services to us:
- Telephony — to send and receive your texts and calls.
- AI model providers — to generate responses from message and call content.
- Hosting and infrastructure — to run and secure the Service and store data.
We may also disclose information if required by law, to protect rights and safety, or in connection with a business transfer. We do not sell your personal information and do not share it with third parties for their own marketing.
07 Data retention
We keep your conversation history and derived memory for as long as your relationship with the Service is active, so the persona can remember you, and as needed for legal, security, and compliance purposes. You can ask us to delete your data (Section 09). Consent and opt-out records may be retained as required to demonstrate compliance. [CONFIRM RETENTION PERIODS WITH COUNSEL.]
08 Voice calls
When you call, your call audio is processed and converted to text so the Service can respond, and a transcript may be stored as part of your conversation history. [CONFIRM CALL-RECORDING / TWO-PARTY-CONSENT DISCLOSURE LANGUAGE WITH COUNSEL — requirements vary by state.] By calling, you consent to this processing.
09 Your choices and rights
- Opt out of proactive messages anytime by replying STOP.
- Access or delete your information by contacting us (Section 12).
- Depending on where you live, you may have rights to access, correct, delete, or restrict the use of your personal information, and to not be discriminated against for exercising them (for example, under the California Consumer Privacy Act). [CONFIRM STATE-SPECIFIC RIGHTS & “DO NOT SELL/SHARE” WITH COUNSEL.]
10 Children
The Service is for adults 18 and older. We do not knowingly allow anyone under 18 to use it, and we do not knowingly collect information from children under 13. We screen for age at first contact and end the conversation warmly if a user is, or appears to be, a minor. If you believe a minor has used the Service, contact us and we will delete their information.
11 Security
We use reasonable technical and organizational measures to protect your information. No method of transmission or storage is perfectly secure, and we cannot guarantee absolute security.
